These Terms of Service (“Terms”) govern your access to and use of the website at https://formeight.in and related services operated by Form8 Life Sciences Pvt Ltd (“Form8”, “we”, “us”). By accessing the site, creating an account (when available), placing an order (when checkout is enabled), or otherwise using our services, you agree to be bound by these Terms and by our policies referenced herein, including our Privacy Policy and legal pages for shipping, refunds, and compliance.

If you do not agree, do not use our services. We may refuse service, suspend accounts, or cancel orders where permitted by law if you breach these Terms or pose fraud, abuse, or legal risk.

Contract formation

These Terms are offered and accepted in accordance with the Indian Contract Act, 1872. Product listings, descriptions, and prices on the site constitute an invitation to treat unless expressly stated otherwise. A binding contract of sale is formed only when we confirm your order in writing (including email or SMS) and accept payment as applicable, or as otherwise described at checkout when commerce is live. We reserve the right to refuse or cancel any order for fraud checks, stock limitations, pricing errors, regulatory restrictions, or breach of these Terms.

All prices are listed in Indian Rupees (INR) inclusive of applicable GST unless stated otherwise. You are responsible for providing accurate billing and delivery information.

Consumer protection

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the Consumer Protection Act, 2019 (“CPA”) and rules framed thereunder, including the Consumer Protection (E-Commerce) Rules, 2020, where they apply to us as an e-commerce entity selling goods to consumers in India. We will honour applicable rights relating to unfair trade practices, deficient services, and misleading advertisements to the extent required by law.

You may have additional rights before consumer fora or ombudsman schemes as may be available from time to time. Our grievance and escalation channels are described in our policies and on our contact page.

Products, FSSAI, and no medical claims

Form8 markets dietary supplements and related products that are regulated as foods or nutraceuticals under the Food Safety and Standards Act, 2006, and rules and regulations issued by the Food Safety and Standards Authority of India (“FSSAI”), including labelling and advertisement requirements. Our FSSAI registration number is 21226181000106. Product labels and this website describe ingredients, intended use as a food supplement, and directions for use where applicable.

Form8 products are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease. Information on this site is for general wellness and education only and does not replace professional medical advice. Consult a qualified physician before starting any supplement, especially if you are pregnant, nursing, have a medical condition, or take prescription medication.

Intellectual property and acceptable use

All content on this site—including text, graphics, logos, product names, and layout—is owned by Form8 or its licensors and is protected by applicable intellectual property laws. You may not copy, scrape, frame, mirror, or exploit our content for commercial purposes without prior written consent. You agree not to interfere with the security or integrity of the site, attempt unauthorised access, or use automated means in a way that imposes an unreasonable load on our infrastructure.

Limitation of liability

To the fullest extent permitted by applicable law, Form8 and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the site or products, except where such exclusion is not permitted by the CPA or other mandatory law. Our aggregate liability for any claim arising out of these Terms or your use of the services will not exceed the amount you paid to us for the specific product or order giving rise to the claim in the twelve (12) months preceding the event, or INR 5,000, whichever is higher, unless a different minimum mandatory liability applies by law.

Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict of law principles. Subject to mandatory consumer forums, you agree that the courts at Bengaluru, Karnataka, India, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of our services.

Changes

We may modify these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms where the law allows; where the law requires explicit consent for material changes, we will obtain it.
